Terms of Use — Echoes of Elarion (Defenders of the Realm)
1. Summary (plain language)
Echoes of Elarion is a game. These Terms are the agreement between you and DeNelle Studios about using it. By installing or playing, you agree to them.
You can play the whole game for free, as a guest, without paying anything and without giving us an account. Nothing in the game requires a purchase.
If you do buy something, you are buying entertainment — nothing else. Crystals and every other virtual item are a licence to use them inside the game. They are not property, not money, and not an investment. They cannot be cashed out, sold, traded, transferred to another player, or exchanged for anything in the real world. The game contains no mechanism to do any of those things and we do not operate one.
Payment is made from your own crypto wallet, directly on the blockchain. We never see your seed phrase or your private keys. Blockchain transfers are final — once a transfer is confirmed, neither we nor anyone else can reverse it. Please read sections 7 to 11 before you buy anything.
2. Acceptance of these Terms
These Terms of Use are a binding agreement between you and DeNelle Studios (“we”, “us”, “our”), the publisher of Echoes of Elarion (the “Game”). By downloading, installing, opening or playing the Game, you accept these Terms. If you do not accept them, do not install or play the Game.
Our Privacy Policy explains what data the Game collects and is part of your agreement with us — see section 14.
3. Who may play
The Game is not directed to children under 13, and you may not use it if you are under 13. Where your local law sets a higher minimum age for using a service like this or for consenting to the processing of your data — for example in the EU and UK, where member states set a digital-consent age between 13 and 16 — that higher local age applies instead. This matches section 7 of our Privacy Policy.
The Game does not ask for your age and has no age gate; we rely on you to tell us the truth about whether you are old enough.
If you are under the age of majority where you live, you may use the Game only with the consent of a parent or guardian, and only a parent or guardian may make a purchase. If you are a parent or guardian and a child has made a purchase using your wallet, please read section 9 first — a blockchain transfer cannot be reversed by us.
4. Your licence to play
We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and play one copy of the Game on a device you own or control, for your own private, non-commercial entertainment.
That is all you get. We keep everything else — the Game, its code, its art, its music, its characters, its writing, its names and its trademarks remain ours (or our licensors’). This licence does not sell you any part of the Game, and it ends if these Terms end.
5. Accounts, guest play, and your save
You can play as a guest. Signing in is optional. Depending on your platform the Game may offer email and password sign-in, Google sign-in, connecting a Solana wallet, or playing as a guest.
A guest save belongs to a device. When you play as a guest, your progress is stored under an identifier derived from your device, not under any personal detail. That means a guest save cannot be moved to another device, and it is lost if you uninstall the Game or change devices. Connecting a Solana wallet is what gives your save an identity that is not tied to one device. If you sign in later on the same device, the progress already on that device stays with you.
Your account and your wallet are yours to protect. Keep your password and your wallet secure, do not share them, and do not let anyone else use your account. You are responsible for everything that happens through your account or your wallet. Tell us at support.EoA@icloud.com if you think either has been compromised.
We do not guarantee that a save can be recovered. Saves can be lost through device failure, an uninstall, a bug, or a failed upload. Nothing in these Terms is a promise that your progress will survive.
6. Acceptable use
While using the Game you must not:
- cheat, exploit bugs for advantage, or use trainers, mods, injectors, memory editors or any tool that changes how the Game runs;
- use bots, scripts, macros or any automation to play the Game or to farm resources;
- reverse engineer, decompile or disassemble the Game, or try to derive its source code, except to the extent that law expressly permits it despite this restriction;
- tamper with, forge or replay the Game’s network requests, or attempt to grant yourself virtual items or currency you did not obtain in the Game;
- attack, overload, probe or interfere with our servers or anyone else’s use of the Game;
- sell, rent, sublicense, or commercially exploit the Game, your account, or anything in it;
- submit content that is unlawful, abusive, hateful, harassing, obscene, or that infringes someone else’s rights (see section 12); or
- use the Game for anything illegal, or in a country where we are not permitted to provide it.
7. Virtual items and virtual currency
The Game contains virtual currencies — including crystals — and virtual items, buildings, cosmetics and other in-game content (together, “Virtual Items”). This section is important, so it is written plainly.
- Virtual Items are a licence, not property. When you obtain a Virtual Item, whether by playing or by purchase, you receive a limited, personal, non-transferable, revocable licence to use it inside the Game. You do not own it, and you acquire no property right, title or ownership interest in it.
- Virtual Items have no real-world or monetary value. They are not money, not a currency, not a security, not a token, not a stored-value or payment instrument, and not a credit balance.
- Virtual Items are not redeemable or exchangeable. They cannot be redeemed or exchanged for cash, for cryptocurrency, for tokens, for goods, or for anything of value outside the Game.
- Virtual Items cannot be traded, transferred or sold. They cannot be sold, gifted, traded, swapped, wagered against, or transferred to another player, to another account, or to any wallet.
- There is no secondary market, and the Game provides no mechanism for one. Value flows one way only: into the Game. There is no cash-out, no withdrawal, no conversion of anything you hold in the Game into money or crypto, and no marketplace of any kind. Any third party who offers to buy, sell or trade Virtual Items is doing so without our authorisation and in breach of these Terms.
- Nothing you buy is an investment. Virtual Items carry no expectation of profit, no promise of future value, no yield, no return and no scarcity guarantee.
- We may change them. We may add, alter, rebalance, re-price, restrict or remove Virtual Items, and change how they are earned or what they do, as part of running and updating the Game.
- Virtual Items end when your access ends. If your account or licence is terminated, or the Game is discontinued, your Virtual Items end with it and you will not be compensated for them. Some items, once bought, are attached permanently to a single save and cannot be bought again or moved elsewhere.
You are buying entertainment. That is the whole of what you receive.
8. Purchases and pricing
Nothing in the Game requires payment. The Game can be played in full without buying anything.
Where the Game offers a pack for sale, the purchase works like this:
- You pay from your own wallet, on-chain. The Game asks your wallet application to approve a transfer of tokens — for example SKR, SOL or USDC — from your wallet address to ours. You approve the transfer inside your own wallet app. There is no app-store billing layer, no card processor and no subscription involved.
- The token amount is the price. A US dollar figure may be shown alongside a pack as a reference only. It is not the amount charged and it is not a guaranteed conversion. The amount charged is the token amount shown for the rail you pay with.
- Token prices move. Because tokens fluctuate against real currencies, the real-world cost of the same pack can differ from one day to the next, and from the reference figure shown. That risk is yours.
- Network fees are yours. Blockchain network fees for the transfer are paid by you, in addition to the price, and we do not receive them.
- Check before you approve. You are responsible for confirming the pack, the token, the amount, the network and the destination address before approving a transfer in your wallet. A transfer sent to the wrong address, on the wrong network, or in the wrong token may be permanently lost, and we cannot recover it.
- We may change prices and contents of any pack at any time, and may withdraw a pack from sale.
- Purchases are one-way. Nothing purchased can be returned, resold, transferred or converted back into tokens or money. See section 7.
We may refuse or cancel a purchase, and may restrict purchasing entirely, where we suspect fraud, abuse, a technical fault, or a breach of these Terms.
9. Refunds
Please read this section before you buy.
Blockchain transfers are irreversible. A confirmed on-chain transfer cannot be reversed, cancelled, charged back or refunded by us, by the Game, by your wallet application, or by any intermediary. There is no chargeback and no dispute process, because there is no payment processor in the middle — the transfer goes from your wallet to ours on a public blockchain.
There is also no app-store billing layer for these purchases, so there is no store refund flow to apply to. Anything you may have read about “contacting the app store for a refund” does not apply here.
Refunds are therefore not available, except where a refund is required by applicable law. All sales are final.
If we ever choose to make a goodwill gesture, it could only take the form of a new, separate transfer or an in-game grant, entirely at our discretion. Nothing in these Terms promises one, and making one in a single case does not oblige us to make another.
If something went wrong — a pack you paid for that did not arrive, a transfer that confirmed but granted nothing — please contact us at support.EoA@icloud.com with your wallet address and the transaction signature, and we will look into it.
10. Your wallet and on-chain transactions
- We never receive your seed phrase or your private keys. The Game does not ask for them, does not store them, and cannot use them. All signing happens inside your own wallet application. Anyone who asks you for your seed phrase — including anyone claiming to be us — is trying to steal from you.
- Your wallet security is your responsibility. Losing your device, your seed phrase or your recovery method may permanently lose you access to your wallet, to anything in it, and to a save keyed to it. We cannot restore a wallet and cannot recover lost keys.
- On-chain transactions are final and public. They are recorded on a public blockchain that we do not control and cannot alter. We cannot reverse, cancel, freeze or amend a transaction once it is submitted.
- We do not control the blockchain, its networks, its fees or its availability. Congestion, outages, forks, failed transactions, or changes made by a network, a validator or a wallet provider are outside our control, and we are not responsible for them.
- You are responsible for your own taxes and for complying with the laws that apply to you where you live, including any law about holding or using digital assets.
- We do not custody tokens for you. We do not hold, manage, invest or safeguard any token or digital asset on your behalf, and we do not operate an exchange, a broker, a wallet service or a money transmission service.
11. Nothing here is an investment
Nothing in the Game — no Virtual Item, no crystal, no cosmetic, no purchase, and no token used to pay for one — is an investment product, a security, a financial instrument, or an offer or solicitation to buy one. We make no representation and no promise about the value, price, liquidity or future performance of any token or digital asset, and no promise that anything you obtain in the Game will hold, gain or retain value. Token values fluctuate, can fall sharply, and can go to zero.
Nothing in the Game or on our pages is financial, investment, tax or legal advice. If you need advice, get it from someone qualified to give it.
12. Content you submit
The Game contains a small number of places where you can type text: a bug report you choose to send us, a referral or invite code you enter, and some local, on-device labels and messages such as a group name or a note that stays on your own device and is not sent to anyone.
You are responsible for what you write. Do not submit anything unlawful, abusive, hateful, harassing, obscene, infringing, or containing another person’s private information. Do not put passwords, seed phrases or private keys in a bug report — we do not want them and we cannot use them.
For anything you do send us, you grant us a worldwide, royalty-free, non-exclusive licence to use, store, copy and adapt it for the purpose of operating, supporting, diagnosing and improving the Game. You keep whatever rights you already had in it. We may remove or refuse any submission, and we are not obliged to keep or return it.
The Game does not currently have public chat, public profiles, or any feature that publishes what you write to other players.
13. Advertising
The Game does not currently show advertisements, and no advertising network is contacted. If we introduce advertising in a future version, watching an advertisement will always be optional — nothing in the Game will require it — and we will update our Privacy Policy before that version ships.
14. Privacy
Our Privacy Policy describes what the Game collects, why, who it is shared with, and what choices you have. It is available at the Privacy link on this site and forms part of your agreement with us. By playing the Game you also agree to the handling of data described there.
15. Third-party services
The Game relies on services we do not control, and their terms and privacy policies apply to you as well as ours. These include:
- your Solana wallet application and the wallet provider that operates it;
- the Solana blockchain and the networks, validators and RPC providers that carry your transaction;
- Google Firebase Authentication, if you sign in with email or with Google;
- the store or platform you obtained the Game from, and the device maker;
- our infrastructure providers, and — in the browser version inside Pi Browser only — Pi Network, if you sign in with Pi.
We are not responsible for those services, for their availability, or for anything they do or fail to do. If one of them changes or stops, part of the Game may stop working.
16. Availability, updates, and changes to the Game
The Game is provided on an “as available” basis. We may, at any time and without liability to you:
- update, patch, change, rebalance, add to or remove features, content and Virtual Items;
- take the Game or its servers offline for maintenance, or without notice;
- limit, suspend or discontinue the Game, in whole or in part, permanently.
If we discontinue the Game we will try to give reasonable notice where we can, but we are not required to, and you will not be compensated for Virtual Items or for progress that ends with it. Updates may be required to keep playing, and an update may change or remove something you liked.
17. Suspension and termination
You may stop at any time by uninstalling the Game. That ends your licence.
We may suspend or terminate your access, your account, or this licence — with or without notice — if you breach these Terms, if we reasonably suspect cheating, exploitation, fraud or abuse, if we are required to by law, or if we discontinue the Game.
When your access ends, your licence under section 4 ends, your Virtual Items end with it under section 7, and no refund or compensation is due. Sections 7, 9, 10, 11, 12, 18, 19, 20, 21 and 23 survive termination.
18. Disclaimer of warranties
The Game is provided “as is” and “as available”, with all faults and without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title, quiet enjoyment and non-infringement.
We do not warrant that the Game will be uninterrupted, timely, secure or error-free, that defects will be corrected, that saves or purchases will never be lost, or that the Game will meet your expectations. No advice or information you get from us creates a warranty we have not given here.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here limits any right you have under consumer law that cannot be limited.
19. Limitation of liability
To the fullest extent permitted by law, and except where a right cannot lawfully be excluded:
- We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, lost saves, lost progress, lost Virtual Items, lost tokens, or loss of goodwill, however caused.
- We are not liable for any loss arising from the blockchain rail, including an irreversible, mistaken, misdirected or failed transfer, a compromised or lost wallet, a lost seed phrase or private key, a fluctuation in token value, or the act or failure of a wallet provider, a network, or any third party.
- Our total liability to you for all claims relating to the Game is limited to the greater of the total amount you actually paid us in the twelve months before the event giving rise to the claim, or US$50.
These limits apply even if a remedy fails of its essential purpose, and even if we were told the loss was possible. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
20. Indemnity
You agree to indemnify and hold harmless DeNelle Studios and its owners, officers and contractors from any claim, demand, loss, liability, cost or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Game, content you submit, your use of a wallet or a blockchain transaction, or your violation of any law or of anyone else’s rights.
21. Governing law and disputes
These Terms, and any dispute arising out of or relating to them or to the Game, are governed by the laws of the State of Texas, United States of America, without regard to its conflict-of-laws rules.
You and we agree that any such dispute will be brought exclusively in the state or federal courts located in the State of Texas, and you and we consent to the personal jurisdiction of those courts.
If you are a consumer resident somewhere whose law gives you the right to bring proceedings in your own country, or gives you protections that cannot be set aside by agreement, this section does not take those rights away from you.
Before starting formal proceedings, please write to us at support.EoA@icloud.com. Most problems are faster to fix that way.
22. Changes to these Terms
We may update these Terms. The effective date at the top will change, and material changes will be noted in-app or on this page. If you keep playing after a change takes effect, you accept the updated Terms. If you do not accept them, stop using the Game and uninstall it.
23. General
These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Game, and replace anything said before. If any part of them is held unenforceable, that part is limited or removed and the rest stays in force. If we do not enforce a provision straight away, we have not waived it. You may not assign these Terms; we may assign them as part of a transfer of the Game or our business.
